SPECIFICS OF RETURNING AND EXCHANGING NON-FOOD ITEMS

4. If a non-food item of unsatisfactory quality has been sold to a buyer and the seller has not discussed its defects with the buyer, the buyer has the right, at their own choice, to demand the following from the seller:

4.1. replacement of the item of unsatisfactory quality with an item of satisfactory quality;

4.2. a corresponding reduction in the price of the item;

4.3. free of charge removal of the item's defects within a reasonable timeframe;

4.4. reimbursement of the costs for removing the defects of the item if the seller failed to remove them within a reasonable timeframe and the defects were removed by the consumer themselves or with the help of third parties;

4.5. unilateral termination of the purchase-sale contract and a demand for a refund of the money paid for the item.

5. The quality guarantee for the item is set by the seller of the item.

6. Items are exchanged or returned at the place of purchase or another location specified by the seller that is convenient for the buyer. The buyer submits a written request to the seller, specifying the defects of the item and one of the requirements from point 4 of these rules chosen by the buyer. The request must be accompanied by the cash register receipt, purchase-sale receipt, or other document confirming the purchase-sale from this seller, as well as the warranty document (if a quality guarantee period has been set for the item sold).

7. If the buyer does not provide a cash register receipt or another document confirming the purchase-sale from this seller issued in accordance with the established procedure, the item is exchanged or other requirements of point 4 of these rules indicated by the buyer are fulfilled only with the seller's consent.

8. In the event of disagreements between the buyer and the seller regarding the quality of the item, the seller, upon receiving the buyer's written request, must contact the State Non-Food Products Inspectorate under the Ministry of Economy (hereinafter - the State Non-Food Products Inspectorate) within no more than 3 working days to assess the quality of the item, and upon receiving its written conclusions, must immediately notify the buyer.

9. If the seller does not fulfill the requirements specified in points 4 or 8 of these rules, the buyer may contact the State Non-Food Products Inspectorate for an assessment of the quality of the goods and, upon receiving its written conclusions, notify the seller.

10. The costs of assessing the quality of the item are paid in accordance with the procedure established by legal acts.

11. The seller and/or buyer may participate in the assessment of the quality of the item if they so wish.

12. Large and heavy (weighing more than 10 kg) non-food items of unsatisfactory quality are transported by the seller for quality assessment, exchange, repair, or return, unless otherwise provided in the purchase-sale contract. The quality of such items may also be assessed at the buyer's home.

13. If the seller proves that the defects in the item arose because the buyer violated the rules for the use or storage of the item, such an item is not exchanged, defects are not removed free of charge, and money is not refunded.

14. If the buyer is not satisfied with the shape, size, color, model, or completeness of the purchased item, they have the right to replace it with an analogous item within fourteen days from the date of the sale of non-food items, unless the seller has set a longer term.

If the seller does not have an item suitable for replacement, the buyer has the right to return the item to the seller and receive a refund of the money paid for it within the term specified in the first paragraph of this point.

15. Items specified in point 14 of these rules are exchanged or returned at the place of purchase or another location specified by the seller that is convenient for the buyer. The buyer submits a written request to the seller, indicating their wish. The request is accompanied by the cash register receipt or purchase-sale receipt, or another document confirming the purchase-sale from this seller.

16. The buyer may exercise the right established in point 14 of these rules if the item has not been used, is not damaged, and has not lost its commercial appearance. Changes to the appearance of the item or its packaging that were necessary to inspect the item shall not be considered as essential changes to the appearance of the item.

17. In the event of a dispute over changes to the appearance of the item or damage to the item, the seller must contact the State Non-Food Products Inspectorate in writing, and upon receiving its written conclusions, must immediately notify the buyer.

18. The buyer's request to replace the purchased item with analogous items or to refund the money paid for the reasons indicated in point 14 of these rules shall not be satisfied upon the purchase of the following items:

perfumery, cosmetics, and toilet preparations (codes according to the Combined Nomenclature - 33.03 - 33.07), photography and cinematography goods (code according to the Combined Nomenclature - 37.00), printed books, reproductions, and other products of the printing industry (code according to the Combined Nomenclature - 49.00), fabrics (codes according to the Combined Nomenclature - 50.07, 51.11-51.13, 52.08-52.12, 53.09, 55.12-55.16), carpet floor coverings, except for carpets and rugs (code according to the Combined Nomenclature - 57.00), knitted men's, boys', women's, or girls' underwear (codes according to the Combined Nomenclature - 61.07 - 61.09), baby clothes (code according to the Combined Nomenclature - 61.11), pantyhose, socks, stockings, and similar articles (code according to the Combined Nomenclature - 61.15), sewn men's, boys', women's, or girls' undershirts, nightshirts, pajamas, and similar articles (codes according to the Combined Nomenclature - 62.07 - 62.08), baby clothes (code according to the Combined Nomenclature - 62.09), brassieres, girdles, corsets, and similar articles (code according to the Combined Nomenclature - 62.12), pearls, precious stones, precious metals, and their articles, except for imitation jewelry (code according to the Combined Nomenclature - 71.00, except 71.17),
machines and mechanical appliances (code according to the Combined Nomenclature - 84.00), electrical machinery and equipment, sound recording and reproduction, and television image and sound recording and reproduction apparatus (code according to the Combined Nomenclature - 85.00), land transport vehicles (code according to the Combined Nomenclature - 87.00), ships, boats, and floating structures (code according to the Combined Nomenclature - 89.00), optical, photographic, cinematographic, measuring, checking, medical, or surgical instruments and apparatus (code according to the Combined Nomenclature - 90.00), watches and clocks (code according to the Combined Nomenclature - 91.00), musical instruments (code according to the Combined Nomenclature - 92.00), arms and ammunition (code according to the Combined Nomenclature - 93.00), furniture, bedding, lamps (code according to the Combined Nomenclature - 94.00), toys, games, except for sports and fishing equipment (code according to the Combined Nomenclature - 95.00, except 95.06 - 95.07).
